Template PPA contract

The EFET-RE-Source template PPA contract is the first cross-country standard for Europe. By using this contract, companies can bring down transaction costs. Starting with a template contract also facilitates the negotiation process between the parties involved. Before its endorsement by the EFET Legal Committee, the standard corporate PPA had been reviewed by industry and a number of financial lenders, who confirmed its bankability.

The standard EFET-RE-Source template contract allows for both physical and financial PPAs with the proven ‘Election Sheet’ approach allowing for flexible tailoring of the PPA to the needs of the companies involved. The agreement has been translated from English into other EU languages to ease its uptake across Europe, and will be supported by legal opinions in key jurisdictions.

"The RE-Source template CPPA was well-received by both sides and especially by RWE Renewables’ in-house legal advisors. It was the perfect starting point for the contracting phase and it saved us a lot of time. I'm happy to say that, thanks to this template, there was no need to make use of external law firms to draft a new agreement. Deviations from the template were also very limited during the contracting process. Our experience was therefore very positive and we expect it to use this template again for our next European PPA."

"“PPAs are complex instruments and this can be daunting for companies looking to sign one for the first time. The EFET/RE-Source template contract offers a useful starting point for companies looking to sign a PPA, by laying out standard terms that can then be adjusted based on the specificities of the deal. The template has served as the basis for many PPAs that have already been signed in Europe, including PPAs that we have signed at Mytilineos.”"
